These Terms & Conditions apply to purchases made through the Lanplus Australia website and to your use of this website.
In these Terms, “Lanplus”, “we”, “us” and “our” means Lanplus Australia Pty Ltd. “You” means the customer, website user or purchaser.
By using this website or placing an order, you agree to these Terms.
1. Orders
When you place an order, you make an offer to purchase the selected products at the displayed price, subject to availability, shipping charges and these Terms.
An order is not accepted until we confirm it or dispatch the goods. We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing, product-description or technical error;
- payment cannot be authorised or verified;
- we reasonably suspect fraud, misuse or an unauthorised transaction; or
- delivery cannot be arranged to the address provided.
If we cannot supply an item, or we cancel an order, after payment has been taken, we will refund the amount we received for the cancelled order or unavailable item.
2. Product information
We take reasonable care to ensure product descriptions, specifications, images, dimensions, compatibility information and prices are accurate. However, product packaging, labels, colours, supplied accessories and manufacturer specifications may change without notice.
Images are for illustration only unless expressly stated otherwise.
You are responsible for checking that the product is suitable for your intended use before ordering. For batteries and electrical products, please check the voltage, capacity, dimensions, terminal type, connector, polarity, charging requirements and compatibility with your equipment.
If you are unsure, contact us before placing an order.
3. Pricing and payment
Prices are displayed in Australian dollars. GST and any applicable charges will be shown at checkout where applicable.
Shipping, freight, optional extras and applicable charges are shown during checkout or otherwise advised before the order is completed.
We may correct pricing or listing errors at any time. If a pricing error affects your order, we will contact you before dispatch to give you the option to proceed at the correct price or cancel for a refund.
Payment must be received and authorised before goods are dispatched or made available for collection.
4. Availability and stock
Products are offered subject to availability. Stock status shown on the website is an indication only and may change before an order is processed.
We may limit quantities, substitute an equivalent item only with your agreement, or cancel and refund an order where stock is unavailable.
5. Delivery and warehouse pickup
We deliver within Australia where service is available. Delivery options, carriers, charges and estimated delivery times may vary depending on the product, delivery location, weight, size and dangerous-goods requirements.
Delivery timeframes are estimates only. We are not responsible for delays caused by carriers, weather, public holidays, incorrect delivery details or events outside our reasonable control.
Some products, including certain batteries, may have delivery restrictions. Freight-only products may not be deliverable to PO Boxes or Parcel Collect addresses.
For warehouse pickup, you must wait for confirmation that your order is ready before attending. Please bring your order confirmation and suitable identification if requested.
Risk in the goods passes to you when the goods are delivered to the delivery address you provide, or when collected from our warehouse.
6. Batteries and electrical products
Batteries and electrical products must be installed, charged, used, stored and disposed of in accordance with the product instructions, relevant Australian standards and applicable laws.
Do not use damaged, swollen, leaking, overheated or incorrectly specified batteries. Do not short-circuit, crush, puncture, modify, disassemble, expose to excessive heat or use an unsuitable charger.
Lithium batteries may have special transport requirements. Do not return a lithium battery without first receiving return instructions from us.
We are not responsible for damage caused by incorrect installation, incorrect charging, misuse, modification, water ingress where the product is not rated for it, reverse polarity, unsuitable equipment, unauthorised repairs or failure to follow supplied instructions.
7. Returns, refunds and consumer guarantees
Our Returns & Refunds Policy and Warranty & Claims Policy form part of these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable law.
Where a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund, depending on the nature of the problem.
For change-of-mind returns, the product must generally be returned in unused, unopened and resalable condition, subject to our Returns & Refunds Policy. Customers are responsible for return postage. Where an order was supplied with free shipping, the actual outbound shipping cost paid by us may be deducted from the refund. No handling fee applies. Please do not send an item back until we have provided return instructions.
8. Warranty
Any manufacturer warranty or Lanplus warranty applies in addition to your rights under the Australian Consumer Law.
Warranty coverage, duration, exclusions and claim procedures are set out in the relevant product listing and our Warranty & Claims Policy.
To make a warranty claim, you may be asked to provide your order number, product details, proof of purchase, photos or video of the fault and other reasonable information needed to assess the claim. If you do not provide the information we reasonably request, we may not be able to assess your warranty or return request.
9. Website use
You must not:
- use this website for unlawful, fraudulent or unauthorised purposes;
- interfere with website security, functionality or other users;
- attempt to gain unauthorised access to our systems or customer accounts;
- reproduce, copy, modify or commercially exploit website content without permission; or
- submit false, misleading or harmful information.
We may restrict or suspend access to the website where reasonably necessary to protect our business, customers or systems.
10. Intellectual property
Unless otherwise stated, website content, branding, text, graphics, photographs, product listings and logos are owned by or licensed to Lanplus and may not be used without prior written permission.
Third-party brand names and trade marks remain the property of their respective owners. They are used only to describe compatibility. A product is not a genuine or OEM part unless the listing expressly says Genuine or OEM.
11. Limitation of liability
To the maximum extent permitted by law, Lanplus is not liable for indirect, incidental, special or consequential loss arising from the use of this website or products purchased from us.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including your rights under the Australian Consumer Law.
12. Changes to these Terms
We may update these Terms from time to time. The version published on the website at the time you place an order will generally apply to that order, unless a change is required by law or is made to correct an error.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute is subject to the courts of Victoria and courts entitled to hear appeals from them.
